Description: this is a project i need to post it in my workplace. these two problems must be answered in two seperate questions,each answer discussing the revelant legal issues covered in the problem. the maximum word limit is 2500...(of total project)
the question is ...
jack and jill run a hotel business with the help of their son Sam. sam worked in the business in varoius roles including manager and barman. he lived in rent free flat above the hotel and took all his meals in the dining roon at no cost to himself. any alchol he consumed at the hotel was free.
his girlfriend sue worked for jack and jill as their accounatant. while in their employment she developed creative accounting software which saved jack and jill many thousands of dollars in tax. in order to earn evtra money she did casual accounting work for another hotel business in a neighbouring town. she obtained this work on account of the creativity she demonstrated in her accounting methods.
sue's employment contract contained a restricitve convent. the restrained were:
1. she would not either during or after her employment with the hotel divulge or communicate any informantion about the hotel's affairs or customers;
2. any notes that she made or that come into her pessession were to be the exclusive property of the hotels;
3. after the termination of her employment she would not be involved in any business concerned in the provision of hotel services for a period of seven years tharoughout south australia.
jack and jill were very angry with sue for taking on the casual work. after a quarrel with them sue said that she would no longer work for tem. jack and jill said to sue that they would sue her if she left.
sam was very offended at the tought of sue being sued and too threathened to resign. jack and jill said to him that he could not leave untill he had repaid the money they ahd lent him for his new car.
now answer this question from the common law perspective with refrence to relevant case law.
1 discuss the fairness (or otherwise) of sue's employment contract with jack and jill.
2 do jack and jill have legal grounds to prevent sam from leaving his job with them?

question 2.

the international business college of knowledge was a privately owned educational institution offering degree courses in business subjects. it employeed five hundered instructors, most of whom under the provisions of the certified collectiove agreement. this agreement provided fo pay increases of three percent per annum for each of the three years of the term of the collective agreement.
as a result of the enthusisam and high quality of its teaching staff the college had made significant improvements in its profitability. over the previous two years the cheif executive officer had been given a pay rise of 70% while the senoir management team had been given pay rise of 60%.
two years inot the colloctive agreement the taching satff comparing their pay rise under the agreement with those of executive staff, coulped with concerns about the rising intreat rates, and their effects on thier mortgages, approaced senoir management to request rises in excess of those under the agreement. senoir management dismissed the request out of head.
300 hundered instructors immedieatly went on strike in support of the pay claim.
while this events were unfolding, the local branch of the AB union which had been waging campaign against the planned changes to the work hour scheme proposed by the government so the opportunity to bring a public attention to its campaign. it did this by picketing the premises of the college, allegedly in support of the striking instructors.
the publicity of these actions, and the effects on enrolments had an immediate adverse effect on the colleges revenue.
1.discuss the legality of the industrial action taken by the instructors and the AB union.
2.the common law actions that are available to the college.
